Delta-8 THC has quickly become one of the hottest selling commodities in the cannabis industry. Despite it being on the DEA's radar and having been banned in some states, in the states where you can still legally buy delta-8 THC, people have been buying it like crazy. Find out if Delta-8 is legal in your state, what exactly it is and how it's different from traditional THC, and much more below.
What Is Delta-8 THC?
Delta-8 is a rare cannabinoid generally thought to have overall milder effects and lower potency than its close cousin, Delta-9 THC. In its natural form, Delta-8 only appears as a trace element in certain strains of cannabis. It's formed in the cannabis plant when Delta-9 THC becomes oxidized during the aging process.
Delta-8 THC provides the same benefits as full-spectrum CBD, along with a gentle buzz similar to that of Delta-9 THC, but not as strong or controlling. While Delta-8 is very similar to Delta-9 THC, its stability and effectiveness make it a better choice for new cannabis users.
How Does Delta-8 Differ From Delta-9 THC?
Delta-9 and Delta-8 THC are genetically identical except for where the chemical bond occurs. Delta-9 is naturally oxidized into the isomer Delta-8 THC during the maturing process of the cannabis plant.
Delta 8 and Delta 9 share identical properties, effects and offer the same value, but in a reduced form for Delta-8 THC. Delta-8 THC lets you experience the full benefits of CBD accompanied by a euphoric effect, but without any chance of the controlling or overwhelming high sometimes associated with traditional THC.
IS DELTA-8 LEGAL ?
The legal status of Delta-8 is complicated, to say the least. The 2018 Farm Bill covers all industrial hemp flower and hemp derived products that contain no more than 0.3% Delta-9 THC, so Delta-8 is covered the same as CBD, CBG, and dozens of other cannabinoids. However, while Delta-8 THC is federally legal in the United States, some states think delta-8 slipped through a "legal loophole," and have banned Delta-8 THC in their state.
As of January 2022, Delta-8 THC has been banned in 19 states. It is NOT legal to buy Delta-8 THC products in the following states: Alaska, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Kentucky, Idaho, Iowa, Michigan, Mississippi, Montana, New York, North Dakota, Rhode Island, Utah, Vermont and Washington.
Can I order Delta-8 products online legally?
Yes, you can order Delta-8 THC products online in most states legally, including vape cartridges, gummies, concentrates, and delta-8 infused hem flower. You will just need to check your own states laws and regulations, and make sure you're buying from a reputable online Delta-8 THC company.
Can Delta-8 THC be shipped in the mail?
Yes, currently the United States Postal Service and other mail carriers do allow Delta-8 to be legally shipped. However, it is important to still check your own state's specific guidelines in regards to mailing hemp derived products like delta-8 THC.
Are CBD and Delta-8 THC products basically the same thing ?
No, Delta-8 and CBD are not the same thing at all. CBD and Delta-8 THC effect people very differently and are produced in very different ways. Delta-8 is reported to cause fairly mild psychoactive effects in comparison to delta-9 THC, but it's still mainly used for recreational reasons or to give cannabis a try. CBD, on the other hand, doesn't have any psychoactive properties at all, so it's mainly used for medicinal purposes.
While Federal regulation is the same for CBD and Delta-8 THC, state-by-state laws on the two cannabinoids are very different: Delta-8 THC is only legal in 32 states, whereas CBD is legal in 47 states.
Is Delta-8 legal in every state?
Delta-8 is protected federally by the Farm Bill of 2018, but 18 states have chose to specifically ban delta-8 THC from being sold in their state.
Can I legally buy Delta-8 THC products?
Yes, you can legally purchase Delta-8 products in the United States, online and in certain retail stores.
